This website offers visitors access to digital teachings, videos, materials, sessions, and a library of information. By accessing or using our website and services, you approve and agree that you have read, understand, and agree to be bound by these terms.

Account Use
In order to use our website and/or receive our services, you must be at least 18 years of age, accompanied by a parent/guardian, or of the legal age of majority in your jurisdiction, and possess the legal authority, right, and freedom to enter into these terms as a binding agreement. You are not permitted to use this website and/or receive our services if doing so is prohibited in your country or under any law or regulation applicable to you.

Right To Change Offering
We may, without prior notice, change the services; stop providing any of the services or features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason. We will always aim to provide all materials of our services that were available at the point of purchase if applicable within 30 days, if our services are changed or terminated for any reason. 

 

Ownership Of Intellectual Property
The services and all materials therein or transferred thereby, including without limitation; software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all intellectual property rights thereto, are the exclusive property of Devon Kramer. Except as explicitly provided herein through notarized writing, nothing in these terms shall be deemed to create a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display or perform, publish, adapt, edit or create derivative works thereof.

Right To Suspend Or Cancel User Account
We may permanently or temporarily terminate or suspend your access to the website, your user account, and/or your access to the service(s) without notice and liability for any reason, including if in our sole determination you violate any provision of these terms, and/or any applicable laws or regulations. You may discontinue use and request to cancel and/or remove your user account, and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically - renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Indemnification
You agree to indemnify and hold Devon Kramer, any 9Vibes Operators, and/or team members harmless from any demands, loss, liability, claims or expenses; including but not limited to attorney's fees; made against them by any third party due to, arising out of, or in connection with your use of the website or any of the services offered on or in connection to the website. 

 

Limitation Of Liability
To the maximum extent permitted by applicable law, in no event shall Devon Kramer, any 9Vibes Operators, and/or team members, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation; damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service(s).

To the maximum extent permitted by applicable law, Devon Kramer, any 9Vibes Operators, and/or 9Vibes team members assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to use of our services and/or information; (iii) any unauthorized access to or use of Wix secure servers and/or any and all personal information stored therein. 

 

Exclusive Ticket Offer - The World Of Learning Program
Our exclusive ticket offer, also known as The World Of Learning Program, includes access to a minimum of 6 live courses, an online classroom, all Ebooks, recordings and slideshows of the live courses during the period of 6 months from February 13, 2023 - August 14, 2023. Ebooks are defined as digital books that have been placed for sale through Amazon Kindle by Devon Kramer. We reserve the right to disclude any courses, workshops, materials and items from this offer during this period of 6 months; with exception to those already stated as included. Attendance of live courses or completion of the online classroom is not required to receive the materials and offered items associated with this offer or program; with the exception of refund requests.

Within 30 days of the original purchase, customers have the option to request a partial refund after attending one full live course, or having successfully completed one course from the online classroom during this period of 30 days. A course in the online classroom is defined as a section that ends with 'course' in its title. A completed course is defined as having fully viewed all materials and items within a course section, achieving a score of 50% or higher on all quizzes within that section, and fully completing all questionaires within that section. Each item successfully completed within different course sections does not meet the requirements of a completed course. All refund requests will be handeled on a case-by-case basis. Refunds will be returned through the original payment method; subject to the timelines and regulations of the third party issuer. Refund requests made after 30 days may be denied. All materials and offered items will continue to be sent to the customer until the refund is finalized by 9Vibes and 9Vibesuniversal. Upon the refund being finalized, any further requests for new or duplicated materials and items will not be fulfilled. All materials and items of refunded tickets and programs, including but not limited to; recordings, slideshows, and Ebooks; are still subject to the Ownership Of Intellectual Property Policy, and all other Terms and Conditions stated above.

We hope that customers understand that we strive to provide an enjoyable, quality experience, and thank them for their purchase. We are happy to consider refund requests after the 30 day period, and will do our best to address them on an individual basis. All materials and offered items of the Exclusive Ticket Offer, The World Of Learning Program, and the Online Classroom Environment are subject to the Ownership Of Intellectual Property Policy, and all other Terms and Conditions stated above.

Group Discussion and Program Guides

The World Of Learning program is subject to the same laws and regulations as other 9Vibes platforms, such as but not limited to Facebook, Instagram, and other websites. All members of The World Of Learning group must adhere to the policies and regulations of the Wix platform and services. 9Vibes encourages everyone to be kind and respectful when interacting with the program and its members. Should a member fail to comply with these guidelines, they may be removed from the group and/or program at the discretion of the 9Vibes team. Refunds and refund requests will also be handled on a case-by-case basis and at the discretion of the 9Vibes team if necessary.
